El Salvador is setting a global precedent with the approval of its pioneering Artificial Intelligence (AI) Law, aligning with President Nayib Bukele’s vision of economic freedom and innovation. This groundbreaking legislation offers regulatory clarity and certainty for the AI industry, specifically fostering the development of both proprietary and open-source AI models.
As the first country to extend legal safeguards to open-source AI development, El Salvador’s law guarantees comprehensive protections for AI systems, ensuring legal certainty for developers. Article 19 of the law establishes the most robust safeguards for AI developers in Latin America and globally, offering protections such as sandbox provisions and shields against third-party misuse, creating a safe environment for innovation.
In addition to providing regulatory frameworks, El Salvador is setting up an AI Lab aimed at promoting the research, development, and application of AI within government services. This initiative is expected to improve essential services, including traffic management, water quality monitoring, and geothermal resource optimization. The Lab will also offer resources and cutting-edge technology to educational institutions, building a domestic engineering capacity to further boost innovation.
El Salvador’s AI Law places the country at the forefront of global AI policy, emphasizing open-source collaboration and legal safety as pillars for future innovation. Along with its zero percent tax rate on AI development, this law offers a unique opportunity to build a thriving AI ecosystem in the region.
With this legislation, El Salvador reaffirms its position as a trailblazer in AI, offering a clear pathway for developers to innovate, collaborate, and contribute to shaping the future of artificial intelligence.
